Chennai: The Central Bureau of Investigation has filed three chargesheets in the court of additional chief metropolitan magistrate Chennai against industrialist AC Muthiah and Farouk Irani the then chaiman and managing director of First Leasing Company of India (FLCIL) a private leasing company in three cheating cases regarding a Rs 665 crore scam. Three banks were allegedly cheated by the accused to the tune of approximately Rs 665 crore. The CBI alleged that the directors/promoters/managing director and key officials of FLCIL hatched a criminal conspiracy with the statutory and internal auditors of the company and unidentified persons with malafide intentions to cheat IDBI bank and had availed credit facilities from the bank on the basis of forged financial reports. The accused also had availed of various credit facilities from the State Bank of India in the name of a private company based in Chennai by furnishing inflated income and assets in the financial statements which was done by creating unsubstantiated entries in the books of accounts since 1998. It also asked for details of the ashram s finances and source of funds.On Wednesday the High Court had asked the Central Bureau of Investigation to inspect the ashram. The order came after NGO Foundation for Social Empowerment and the parents of three girls moved the court claiming many young women were raped at the Adhyatmik Vishwa Vidyalaya and several had committed suicide but no case was ever registered. A court-appointed committee which included Delhi Commission for Women s chief Swati Maliwal and the police had inspected the facility on Wednesday. Over 100 girls were housed in animal-like conditions with no privacy advocate Nandita Rao told the court. She also said that many who were confined there appeared to be under the influence of narcotics. The inmates were kept in close confinement in dark spaces with no sunlight and metal grill with nowhere to exit. The sleeping area is also monitored and the girls have no privacy. GURUGRAM: The Central Bureau of Investigation (CBI) on Friday opposed the bail application of class XI student of the Ryan International School Bhondsi suspect for murdering class 2 student Pradhyumn Thakur of the same school. CBI argued that investigation is at a crucial stage and they have yet not recorded statements of some witnesses. They also said that the Juvenile if granted bail can tamper with evidence influence and intimidate the witnesses. The juvenile was produced before child sessions court of additional sessions Judge JS Kundu for the first time after the Juvenile Justice Board s decision to try child in conflict with law as adult. Court extended the judicial custody of the child till January 3 and scheduled next hearing on bail application on January 6. Juvenile s counsel Sandeep Aneja said they had moved bail application under rule 10(5) of Juvenile Justice (Care & Protection of Children) Model Rules 2016. Under the rule agency should have completed the investigation in one month from the date of detention or arrest of child and submit their chargesheet. As CBI has failed to complete the investigation in the given time the child should be given benefit of default bail said Aneja adding that they filed two more appeals - one to challenge the JJ board order allowing CBI to take fingerprint of juvenile and second to appeal to challenge the legality of custody of the child given to CBI from November 8-11. Hearing on all these appeals will take place on January 6. Opposing the bail appeal CBI argued that rule 10(5) of Juvenile Justice (Care & Protection of Children) Model Rules 2016 nowhere speaks about completion of investigation within one month. As per the said rule in cases of heinous crime alleged to have committed by child who has not completed the age of 16 years child welfare police has to produce the statements of witness and documents prepared during investigation to the board within a period of one month from the date of first production of child said CBI in its reply. In the present case CBI has produced the records case diaries of the case before JJ Board at the time of taking custody of child on November 8 and at the time of sending him to observation home on November 11 mentioned CBI reply filed in the court. Seeking extension of the judicial custody of child CBI argued that investigation in the case is still pending and is at crucial state. Certain witnesses are yet to be examined. He may temper with the evidence influence and intimidate the witnesses. He may abscond which may hamper the course of investigation CBI reply. CBI mentioned that JJ board order to try child in conflict with law as adult assumes great significance as it speaks about the mental status of apprehended child and heinous nature of the crime committed by him. Sushil Tekriwal counsel for Pradhyumn s father Barun Thakur said CBI argued that contention made by child is not tenable and offence committed by him is heinous and punishable with not less than 10 years. Hence the benefit of default bail can be given to child only after completion of 90 days since his arrest in the case which is going to expire on February 4 2018. Quoting the order of JJ Board passed while rejecting the bail appeal of juvenile CBI mentioned that under the rule investigation agency shall produce statements of witnesses recorded by them and other documents prepared during the period of one of month the first production of child before board. It is nowhere mentioned in the rule 10(5) the investigation has to be completed within one month in the case of heinous offences. Tekriwal said earlier case was shifted from special women and child court to child sessions court. With this issues related to jurisdiction of the case has settled to great extent. Now CBI will file the chargesheet related to child in the child session court Gurgaon which will conduct the trial of the case said Tekriwal.
